Dear Dr.Qamar, and members. Please explain 5/1-3. Although Doctor sahab has explained some terminologies, but I would like to know the complete understanding of these ayats. Thanks

Dear Brother Waseemameer! the sense/translation of veses 5/1-2 is presented as under.Remember the verse 5/3 has already elaborated by Dr. Qamar in the article "Halal o haram"( i agree with).  
 
أَيُّهَا الَّذِينَ آمَنُواْ أَوْفُواْ بِالْعُقُودِ أُحِلَّتْ لَكُم بَهِيمَةُ يَا  
الْأَنْعَامِ إِلاَّ مَا يُتْلَى عَلَيْكُمْ غَيْرَ مُحِلِّي الصَّيْدِ وَأَنتُم  
ْ حُرُمٌ إِنَّ اللّهَ يَحْكُمُ مَا يُرِيدُ  
الصَّيْدِ= A man un able to look aside,Annoyed,hurt.  
O you who live in peace, fulfill [all] contracts. Lawful for you are the abundant bounties except for that which is recited to you [in this Qur'an] being not permitted, not to annoyed/hurt you, while you are law abider. Indeed, Allah ordains what He intends.  
 
يَا أَيُّهَا الَّذِينَ آمَنُواْ لاَ  
تُحِلُّواْ شَعَآئِرَ اللّهِ وَلاَ الشَّهْرَ الْحَرَامَ وَلاَ الْهَدْيَ وَلاَ  
الْقَلآئِدَ وَلاَ آمِّينَ الْبَيْتَ الْحَرَامَ يَبْتَغُونَ فَضْلاً مِّن  
رَّبِّهِمْ وَرِضْوَانًا وَإِذَا حَلَلْتُمْ فَاصْطَادُواْ وَلاَ يَجْرِمَنَّكُمْ  
شَنَآنُ قَوْمٍ أَن صَدُّوكُمْ عَنِ الْمَسْجِدِ الْحَرَامِ أَن تَعْتَدُواْ  
وَتَعَاوَنُواْ عَلَى الْـبِـرِّ وَالتَّقْوَى وَلاَ تَعَاوَنُواْ عَلَى الْإِثْم  
ِ وَالْعُدْوَانِ وَاتَّقُواْ اللّهَ إِنَّ اللّهَ شَدِيدُ الْعِقَابِ  
الْهَدْيَ= see verse 2/196,2/38  
الْقَلآئِدَ = Who undertook/imposed upon himself the responsibilities of affairs  
O you who live in peace, do not violate the rites of Allah(شَعَآئِرَ اللّهِ) and the known forbidden in the society (وَلاَ الشَّهْرَ الْحَرَامَ ) and the divine message(الْهَدْيَ) and the sanctity of the people who undertook the responsibilities of affaire and sanctity of the sacred institution(based on Islamic ideology) and [violate the safety of] those faithful/obedient to the Sacred institution seeking فَضْلا and وَرِضْوَانًا from their Lord and [His] approval. But when/if you violated, sure you huredt on pride, . And do not let the hatred of a people for having obstructed you from al-Masjid al-haram( the commandments of don’ts/forbidden and lead you to transgress. And cooperate in righteousness and piety, but do not cooperate in sin and aggression. And. وَاتَّقُواْ اللّهَ (keep in mind the ultimate results as a “makafat e amal) ; indeed, Allah is severe in penalty

Brother Moazzam! It seems that the sense of each and every commandment has been changed by orthodox translators/interpreters in support of their rituals.  
I really astonished, by reading your new translation of verse 5:1-2. How Aastana would convince the Dhulqarnain like people who totally depends on orthodox translations????

Dear Waseemameer! تَحِلَّةَ is divided into 2 morphological segments. A verb and subject pronoun. The form IV imperfect verb (فعل مضارع) is second person masculine plural and is in the jussive mood (مجزوم). The verb's triliteral root is ḥā lām lām (ح ل ل). The suffix (الواو) is an attached subject pronoun see the verse 66/2  
قَدْفَرَضَ اللَّهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ وَاللَّهُ مَوْلَاكُمْ وَهُوَالْعَلِيمُ الْحَكِيمُ

1. صَّيْدِ has been translated as " prey" by Dr Qamar in his response to 5/96  
2. فَاصْطَادُوا root is saad-yeh-daal. Which baab is this?I couldn't figure out yet?

Dear Waseemameer!لَيَبْلُوَنَّكُمُ = It is to make declared for you ,see the verseيَوْمَ تُبْلَى السَّرَائِرُ  
الْبَرِّ = the state of free from sickness/desease, taken the sense as free from crisis.  
الْبَحْرِ = State of sudden crisis, signifying the crisis of desease, sudden change which happens to a sick person  
الصَّيْدِ = A man un able to look aside ( due to act of pride),Annoyed, hurt  
يَا أَيُّهَا الَّذِينَ آمَنُواْ  
لَيَبْلُوَنَّكُمُ اللّهُ بِشَيْءٍ مِّنَ الصَّيْدِ تَنَالُهُ أَيْدِيكُم  
ْ وَرِمَاحُكُمْ لِيَعْلَمَ اللّهُ مَن يَخَافُهُ بِالْغَيْبِ فَمَنِ اعْتَدَى بَعْدَ  
ذَلِكَ فَلَهُ عَذَابٌ أَلِيمٌ  
O you who live in peace, Allah will surely declare for you about something of الصَّيْدِ that your hands and spears [can] reach, that Allah( through his state) may make evident those who fear Himبِالْغَيْبِ . And whoever transgresses after that – for him is a painful punishment.  
 
 
يَا أَيُّهَا الَّذِينَ آمَنُواْ لاَ  
تَقْتُلُواْ الصَّيْدَ وَأَنتُمْ حُرُمٌ وَمَن قَتَلَهُ مِنكُم مُّتَعَمِّدًا  
فَجَزَاءٌ مِّثْلُ مَا قَتَلَ مِنَ النَّعَمِ يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِّنكُم  
ْ هَدْيًا بَالِغَ الْكَعْبَةِ  
O you, who live in peace, do not قَتَلَ (kill/humiliate) الصَّيْدَ while you are in the state of law abider and obedience. And whoever of you make قَتَلَ (kills/humiliates) him intentionally – the penalty is an equivalent from النَّعَمِ to what he قَتَلَ killed/humiliated/, as judged by two just men among you the most learned بَالِغَ الْكَعْبَةِ( dignities).  
 
أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ  
وَطَعَامُهُ مَتَاعًا لَّكُمْ وَلِلسَّيَّارَةِ وَحُرِّمَ عَلَيْكُمْ صَيْدُ  
الْبَرِّ مَا دُمْتُمْ حُرُمًا وَاتَّقُواْ اللّهَ الَّذِيَ إِلَيْهِ تُحْشَرُون  
َLawful to you is the قَتَلَ of صَيْد when you are (imposed) in the state of sudden crisis ,and to comprehend the situation to overcome it, is beneficent to you and to those (groups) who are in the learning stage, and forbidden to you is the(قَتَلَ) of صَيْدُwhen you became free of crisis, as long as you are in the state of law abider/obedience . And fear Allah( keep in mind the law of makafat-e-amal) to whom( the Islamic state) you will be gathered

* What do when they (jhagralo, proud ) are under your power (your hands can reach them)?  
 
* Do not kill them, let Allah (state, through its experts, professionals) explain/ decide what to do when time comes  
 
*transgressors will be punished ( They are clearly taking qanoon apne hath main, and qanoon is not andha)  
 
* If you are obedient, do not kill them  
 
*If you still kill them, then the punishment for is equal to your crime (everything covered under the parameters of "qatl")  
 
*but if it is imposed on you in the time of crisis, you have to what you have to do (again, everything covered under the parameters of qatl)  
 
*When your free from any crisis, then it is forbidden for you to kill as long as you are obedient (when the condition of peace is restored, same rules of not killing is to be established)  
 
did I get it right?  
 
This is not nice, I was planning to go fishing in mecca :(

The quarry is about verse 96 of sura 5 ,  
 
أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ مَتَاعًا لَكُمْ وَلِلسَّيَّارَةِ وَحُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا وَاتَّقُوا اللَّهَ الَّذِي إِلَيْهِ تُحْشَرُونَ (٩٦)  
This verse has no Arabic word which can be tranlated as FISH or SEA FOOD.  
The question arises then why the translations say FISH or SEAFOOD.  
Because There is a word in this verse البحر which is translated as sea and another word صید which is translated as hunted .  
So the word in the verse صید البحر is translated as hunted fish or sea food.  
To understand the meaning of the whole concept one has to see the background of the verse and the subject discussed in the sura.  
The subject of the sura is “basics of the relations between Momins and others.”  
And the background of the verse is “ the non Muslims who fall prey in the hands of momins”  
We will begin from verse 94  
 
يَا أَيُّهَا الَّذِينَ آمَنُوا لَيَبْلُوَنَّكُمُ اللَّهُ بِشَيْءٍ مِنَ الصَّيْدِ تَنَالُهُ أَيْدِيكُمْ وَرِمَاحُكُمْ لِيَعْلَمَ اللَّهُ مَنْ يَخَافُهُ بِالْغَيْبِ فَمَنِ اعْتَدَى بَعْدَ ذَلِكَ فَلَهُ عَذَابٌ أَلِيمٌ (٩٤)  
يَا أَيُّهَا الَّذِينَ آمَنُوا لا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ هَدْيًا بَالِغَ الْكَعْبَةِ أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ أَوْ عَدْلُ ذَلِكَ صِيَامًا لِيَذُوقَ وَبَالَ أَمْرِهِ عَفَا اللَّهُ عَمَّا سَلَفَ وَمَنْ عَادَ فَيَنْتَقِمُ اللَّهُ مِنْهُ وَاللَّهُ عَزِيزٌ ذُو انْتِقَامٍ (٩٥)  
أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ مَتَاعًا لَكُمْ وَلِلسَّيَّارَةِ وَحُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا وَاتَّقُوا اللَّهَ الَّذِي إِلَيْهِ تُحْشَرُونَ (٩٦)  
جَعَلَ اللَّهُ الْكَعْبَةَ الْبَيْتَ الْحَرَامَ قِيَامًا لِلنَّاسِ وَالشَّهْرَ الْحَرَامَ وَالْهَدْيَ وَالْقَلائِدَ ذَلِكَ لِتَعْلَمُوا أَنَّ اللَّهَ يَعْلَمُ مَا فِي السَّمَاوَاتِ وَمَا فِي الأرْضِ وَأَنَّ اللَّهَ بِكُلِّ شَيْءٍ عَلِيمٌ (٩٧)  
اعْلَمُوا أَنَّ اللَّهَ شَدِيدُ الْعِقَابِ وَأَنَّ اللَّهَ غَفُورٌ رَحِيمٌ (٩٨)  
 
“O you momins God will put you to test by those things which may come within your powers reach or your weapons . So that God knows who fear from him when he is  
Beyond , and for those who transgresses the bounderies after this will be punished severely. 5-94  
O you Momins don’t kill the prey wile you are under a proclamation of binding.  
And whosoever amongst you kills intentionally for pleasure will be punished accordingly. The decision will be taken by two judges from you , according to most  
Perfect guidance of Kaba ( QURAN ) or the responsibility of those who are in need,or  
Trainings periods , so that he faces the consequences of his deeds.God forgives the past but whoever repeats the act , the court of law of Quran itself will take stern action because Court of law of Quran is capable of punishing .5-95  
These verses are not for any pilgrimage or for killing animals .These are the basic guidance of reactions of Momins when they encounter any opposition.  
Some of the words needs understanding according to the context.  
These verses as you see are not for slaughtering animals as,  
If someone slaughters an animal has to provide another animal of the same physique to be slaughtered. ( two wrongs never make one right ) if slaughtering is forbidden then it can not be repeated to justify the first slaughtering .  
The word انتم حرم never means that you are wearing a typical dress of Pilgrimage .  
Its simple translation is “ when you are hurum حرم “…………حرم means binding ,forbidden stopped from doing something.  
So “ انتم حرم “ means when you are forbidden, stopped or bounded by an order .  
The other word is صید Which means prey.  
A prey can be an animal and also a person who falls prey in the hands of a cruel person .  
The third word is قتل which means to fight or to kill.It is not used for slaughtering an animal usually. The sura is describing the fight between the momins and the Other people who stood against the momins.So why should we take this killing or fight for an animal .  
The decision for the punishment will be taken by two experts from judiciary ذوا عدل منکم  
Shows the depth of the crime .Not only this but the way God himself is said to take revenge if the act is repeated clearly indicates the depth of seriousness of the act which is taken as tyranny.  
The verse is about the fight between Momins and those who are not accepting the Quranic way of governance .  
In such a situation if someone from the opposition falls prey in Momins hand he should not be persecuted . Because of some declaration which stops them from doing so. But if someone does against the orders he is punishable under the law.  
Now comes the verse 97 which has the word صید and بحر As explained صید is not animal but the people of opposing forces who fell prey in Momins hands and hence restrained The other word is البحر which is translated as sea ,river ,or ocean.  
The word البحر is from root letters ب ح ر . the other words made from these root letters explain its meanings  
To split , to deepen a pit , to be confused ,to be thirsty ,crisis  
Now some quotations from قا مو س الو حید page150  
تبحر فی المال A rich person  
تبحر فی العلم A Knowledgeable person  
البا حر An idiot  
البحر ان Confusion crisis  
So صید البحر means those who fall prey in your hands because of their foolishness or confusion or crisis in matters of governance.So lets study the verse96 with its meanings  
 
أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ مَتَاعًا لَكُمْ وَلِلسَّيَّارَةِ وَحُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا وَاتَّقُوا اللَّهَ الَّذِي إِلَيْهِ تُحْشَرُونَ (٩٦)  
 
It is permissible for you and for those who are away to restrain the ones who produced crisis in governance with their resources but it is forbidden to restrain those who are pious but fall prey till you are under proclamation of restriction. Abide by the Values and Parameters of Allah (Quran).You ill be answerable to him.  
The next verse further explains  
جَعَلَ اللَّهُ الْكَعْبَةَ الْبَيْتَ الْحَرَامَ قِيَامًا لِلنَّاسِ وَالشَّهْرَ الْحَرَامَ وَالْهَدْيَ وَالْقَلائِدَ ذَلِكَ لِتَعْلَمُوا أَنَّ اللَّهَ يَعْلَمُ مَا فِي السَّمَاوَاتِ وَمَا فِي الأرْضِ وَأَنَّ اللَّهَ بِكُلِّ شَيْءٍ عَلِيمٌ (٩٧)  
The word جعل means presented produced laid down appointed and made .So the meanings of the verse is ,  
Allah has presented الکعبۃ البیت ( Quranic institution) قیا ما للناس basis to take stand for the mankind ,ie the prohibited conditions ,and the guidance,and the idealogy you follow  
قیا ما للناس basis to take stand for the mankind .  
This is to make you understand that God knows everything in heavens and earth and he has the knowledge of everything.  
 
I hope , I have made the verse clear . If someone has better choice of words please do come forward and contribute your knowledge to Quranic teachings with an aim to serve humanity. *******

Seems like the same thing has been said-The point is that there is no talk of animals/ wildlife, but human beings (“ the non Muslims who fall prey in the hands of momins” .)  
 
So the way I get it is that صید are people on the opposite side/in conflict with Momins, who fall l prey in their hands/ power. That would be the prey, humans from opposite party, who fall under your power because of their foolishness / confusion or crisis in matters of governance.  
 
It’s a basic guidance on the reactions of Momins when they encounter any opposition. The instruction is given in what to do with the “quarry” in the state of crisis and when the crisis is over.  
 
The verse is about the warfare/ battle between Momins and those who are not accepting the Quraniq way of governance. In such a situation if someone from the opposition falls prey in Momins hand he should not be wronged. Because of some commands which prevents them from doing so. But if someone goes against these orders, he is liable to be punished by the law  
 
Thats the essence I get through both the explanations though

dear Dr:Qamarzaman ,regaurds, kindly explain the marriage with 1st cousins,as the ayat no 22-24 of Alnisa gives the halal-o-haram limits.
