It depends on which society your living in. In the West, there is no requirement to get married before being together, are couples who lives in this society still breaking the society's laws?

You can't enjoy sex without NIKKA (an agreement in accordance with concerned society's law)
If a society allows sex without Nikkah , it will be UN-Islamic society.

To my understanding, Nikah is a contract which is a legally enforceable agreement between two parties with mutual obligations. The contract is a management document that says what the parties have undertaken to do. It should provide the basis for a fully satisfactory presentation of the privileges and obligations both are dedicated to. The contract is a written document of what two people have agreed to do to fulfill the obligations undertaken.

I never knew Nikah was a certificate to have sex? Normally, is it written in the “Nikah Nama” that you now can have sex (without being stoned to death)? Just wondering :-O

Traditionalist give reference of these two verses to prove that marriage (nika) is only allowed with following. Reference (4-23 to 24) and (5-5).
However, these verses needs to be checked with proper context and grammer and root word meaning.
The criteria you find in these verses are very close to Jewish tradition. However the extreme combinations (4-23&24) given in these verses are not 100% found even in ancient cultures. There is always few exceptions that you may find that people commit but it does not tell us what was the cultural norm.
One of the argument normally given is that men used to marry these combinations as stated in (4-23&24) in order to keep inheritance not to be divided. In my research woman inheritance rights are always been curtailed in ancient cultures. This argument has no solid bases. You can use your imagination and figure out.
Multiple wives and mistresses is common all along the history. Even woman with multiple partners. Marriage institute is mostly enforced through organized religion historically and state endorse it.
I leave to my other brothers to provide some insight.

Dear all.

Now that Quranic references have already been quoted by brother AlAhemer, I would like to discuss the

issue from intellectual point of view. We need to understand,

1.Family. Family institution is the basic social unit. This is an institution where children are born, brought

up trained and educated. It also performs certain other functions like looking after old and weak. It is a

natural institution , we see it animals also forming their own family institution as it suits their requirement.

This institution needs to be strengthen to produce good human beings.

2.. Sex. Sex in nature is for the purpose of reproduction. Continuity of human race depends on it. Pleasure

associated with it is not the primary purpose. Sex naturally has to be allowed between a male and a female

who enter in to a contract (nikka) so that these potential parents could be held responsible for the duties

expected out of them to form a good family. How can sex be allowed without a contract to form a family.

Wife and husband have to be bonded with love. Love between them can not exist without sexual loyalty

to each other. Without love family becomes hell. I personally feel that there should be strict laws enforced

in a society to punish offenders. I have understood the same from Quranic teachings and find

it close to human nature as well.

3. Sexual freedom in the western culture is their greatest weakness. It is disgraceful, disgusting and hateful.
